These terms cover your use of this website, the packages you can buy through it, and the general framework for design and development work carried out by the studio.
Beyond the published packages, the commercial detail of an individual project — anything outside the listed scope, how many extra revisions are covered, and what happens if it is canceled mid-build — is set in the written proposal or statement of work accepted for that project.
By using this website you agree to these terms. If you do not agree with them, please do not use the site.
If you engage the studio for a project, these terms apply alongside the proposal or statement of work for that project. Where the two conflict, the signed proposal or statement of work takes precedence.
The studio offers website design, website development, brand identity design, the visual setup of social profiles, and printed or digital business materials. Hosting and domain setup are included where a proposal says so.
Descriptions and example work shown on this site are illustrative. They do not by themselves form an offer or a commitment to deliver any particular scope.
Before work begins you receive a written proposal or statement of work. That document defines the project and governs it.
Anything project-specific is decided there rather than on this page, including:
Projects depend on input from you. To keep a project moving you agree to provide the information, content and approvals the project needs, and to give feedback within the timeframes agreed in the proposal.
Delays in feedback, content or access to accounts will move the project timeline. Where that happens we will tell you the effect rather than absorb it silently.
You are responsible for the text, images, logos, video and other material you give us to use. By supplying it you confirm that you own it or have the right to use it, and that using it on your website and materials does not infringe anyone else's rights.
We may decline to publish material we believe is unlawful, infringing or misleading.
Each proposal states how many rounds of revisions are included. Revisions are for refining agreed work.
A request that materially changes the direction, adds deliverables or expands the scope is new work. We will quote it before producing it, so nothing is invoiced that you have not agreed to first.
Buying a package requires an account. You are responsible for the accuracy of the details you give and for keeping your password to yourself. Tell us promptly if you believe someone else has access to your account.
Your account holds your brief, your orders and the workspace for each project. It is not a public profile and nothing in it is shown to anyone but you and the studio.
This website takes payment. The package prices shown are the amounts charged at checkout, in US dollars, before any tax that applies to your location. Tax, where it applies, is calculated by our payment processor at checkout and shown before you pay.
Payment is taken in full at checkout unless your proposal says otherwise, and work begins once it has cleared. Card details are entered directly with Stripe, our payment processor; this site never receives or stores them.
A promotional code, where one applies, reduces the price of the website build only. Website Care is not discounted.
Every website carries a 30-day warranty that begins on the day it is launched. During that period, faults in the build we delivered are fixed at no charge.
The warranty covers our own work. New content, new functionality, changes made by you or by a third party, and problems originating in services we do not operate are not covered, and are quoted as additional work.
Website Care is an optional monthly service at $59 per month, bought together with a website and not afterwards. It belongs to that specific project: holding it on one website does not cover another.
The first month is paid with the build. Coverage begins when the 30-day post-launch warranty ends, because during the warranty the same faults are already covered at no charge, and the first recurring payment falls one month after coverage starts.
Where a package includes hosting and a domain, the included period and what happens after it are stated in the proposal.
Hosting and domain registration are provided by third parties and are subject to their own terms. Domain registration is also subject to registry rules, including rules on renewal and transfer, which are outside our control.
Projects often rely on services we do not operate, such as hosting, domain registrars, email providers and social platforms. We can set these up for you, but we do not control them and are not responsible for their availability, pricing changes or policy changes.
Where a third-party service requires an account, we will normally set it up in your name so that you own it.
This website, including its design, text and code, belongs to the studio unless stated otherwise.
For client projects, ownership of the delivered work transfers to you as set out in your proposal. Some elements may remain licensed rather than owned — typefaces, stock assets and third-party components are licensed on their own terms, and those licenses pass to you as they are. Your proposal identifies anything of that kind.
We would like to show completed work on this site and in presentations. If you would prefer we did not, tell us and we will not publish it.
We do not publish confidential business information, and we do not publish a client's private contact details.
We aim to keep this website available and accurate, but we do not guarantee that it will be uninterrupted or error-free. Content may change without notice.
Design and development work is a professional service, not a promise of a commercial outcome. We do not guarantee particular traffic, search rankings, inquiries, sales or revenue, because those depend on factors outside the work we deliver.
To the extent permitted by law, the studio is not liable for indirect, incidental or consequential losses arising from the use of this website or from the services, including lost profits, lost business or lost data.
Nothing in these terms limits liability where the law does not allow it to be limited.
Either side may end a project in the circumstances set out in the applicable proposal or statement of work, which also governs what is payable for work already carried out.
We may restrict access to this website at any time.
We may update these terms. The date at the top of this page shows when the wording last changed, and the version published here is the one that applies.
Changes do not alter the terms of a proposal or statement of work already accepted for a project.
The studio operates from Arizona, United States. These terms are governed by the laws of the State of Arizona and applicable United States federal law, without regard to conflict-of-law rules.
